Herdspace – Terms and Conditions

Please read these Terms and Conditions carefully before using herdspace.co.uk (the "Website") or any services provided through it.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.


1. Who we are

Herdspace Ltd ("Herdspace", "we", "us", "our") operates an online advertising and discovery platform for the equestrian sector.

Herdspace is not a broker, agent, dealer, intermediary, or adviser. We do not participate in, facilitate, verify, negotiate, guarantee, or oversee transactions between buyers and sellers.


2. Scope of our services

Herdspace provides a platform only which allows:


  • sellers/advertisers to publish listings
  • users to browse, search, and enquire
  • users to interact directly with one another


All transactions, communications, representations, negotiations, and agreements are strictly between buyers and sellers.


We do not:

  • verify identity, ownership, history, suitability, or legality of listings
  • inspect animals, goods, or services
  • provide valuations, recommendations, or advice
  • guarantee accuracy, availability, or outcomes


3. User responsibility & risk

All users acknowledge and agree that:


  • the accuracy of adverts is the sole responsibility of the advertiser
  • Herdspace does not validate listings or user claims
  • any purchase or engagement is undertaken entirely at the user's own risk
  • professional advice (e.g. veterinary, legal, transport, export) should be sought where appropriate


You agree to conduct your own due diligence before entering any transaction.


4. AI-powered features disclaimer

Herdspace may offer AI-powered search, tagging, suggestions, or discovery tools.

These features:


  • are generated automatically
  • are based on user-submitted information and behavioural patterns
  • may be incomplete, inaccurate, or unsuitable


AI outputs are for informational purposes only and do not constitute advice, verification, endorsement, or guarantees of suitability.

Users must independently verify all information before relying on it. Herdspace accepts no liability arising from reliance on AI-generated outputs.


5. User accounts & security

Users may be required to create an account to access certain features.

You are responsible for:


  • keeping login credentials secure
  • all activity carried out under your account
  • ensuring information you submit is lawful and accurate


Herdspace does not verify user identity beyond basic platform access controls.


6. Advertiser obligations

By submitting an advert, you confirm that:


  • you have the legal right to sell or advertise the item or service
  • the listing complies with UK law and any applicable international regulations
  • all information provided is accurate, lawful, and not misleading
  • you agree to pay applicable advertising fees


Each advert is limited to a single item or listing. Substitutions are not permitted.


7. Editorial control & content standards

Herdspace reserves the right, at its sole discretion, to:


  • reject, remove, suspend, or amend adverts
  • we may amend adverts so your listing utilises more of the platform's features. 
  • prohibit user access
  • withhold fees where terms are breached


Editorial amendments (e.g. spelling, formatting, image quality) are non-substantive and do not constitute verification or endorsement.

Links to competitor or alternative classified platforms are prohibited.


8. Trade sellers

Trade sellers must not misrepresent themselves as private sellers.

Under the Consumer Protection from Unfair Trading Regulations 2008, commercial status must be clearly disclosed.


Herdspace may remove adverts reasonably suspected of misrepresentation without refund and is not obliged to investigate seller status beyond reasonable suspicion.


9. Photographs & media

Advertisers confirm they have permission to use all submitted images and media.

Herdspace accepts no liability for copyright disputes and may remove disputed media immediately and without notice.


10. Prohibited use

Users must not:


  • misuse AI tools or attempt to manipulate results
  • scrape, harvest, or extract data without permission
  • use bots, automated tools, or scripts
  • submit false, misleading, or unlawful content
  • harass, spam, or abuse other users
  • attempt to bypass fees, restrictions, or security measures


11. Fees, cancellations & refunds

Once an advert is published, the service is deemed delivered.


You may remove an advert at any time, but no refunds will be issued, except where required by law.

Website downtime or service interruption does not entitle users to refunds.


12. Third-party services & advertisers

Herdspace may display third-party adverts or links.

We do not endorse, verify, or accept responsibility for third-party products or services. All dealings are strictly between the user and the third party.


13. Liability & disclaimers

To the fullest extent permitted by law:


  • Herdspace excludes all liability for losses arising from use or inability to use the Website
  • we do not guarantee uninterrupted access or error-free operation
  • we are not liable for indirect, consequential, or economic losses


Nothing in these Terms excludes liability where unlawful to do so.


14. Intellectual property

All Website content, design, systems, and functionality belong to Herdspace or its licensors.

Users are granted a limited, non-exclusive licence to use the Website for personal, lawful purposes only.


15. Data protection

Personal data is processed in accordance with our Privacy Policy and Cookie Policy. Herdspace Ltd is registered with the ICO under registration number: ZB873695.


16. Force Majeure

Herdspace shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to:


  • acts of God, flood, drought, earthquake, or other natural disasters
  • epidemic or pandemic
  • terrorist attack, civil war, civil commotion, riot, or threat of any such events
  • war, armed conflict, or sanctions
  • any law or action taken by a government or public authority
  • collapse of, or failure of, third-party infrastructure including internet service providers, hosting platforms, payment processors, or telecommunications networks
  • fire, explosion, or accident
  • industrial action or labour disputes

In such circumstances, Herdspace will take reasonable steps to notify affected users and to resume normal service as soon as reasonably practicable. Where a force majeure event results in a prolonged interruption to the service, Herdspace reserves the right to suspend or terminate affected services without liability.


For the avoidance of doubt, a force majeure event does not entitle users to a refund of listing fees already paid.


17. Assignment

Herdspace may transfer or assign this agreement to another entity. Users will be notified if this occurs.


18. Governing law & jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.


19. Changes to these terms

We may update these Terms at any time. Continued use of the Website constitutes acceptance of the updated Terms.
